David Lee obtains a defense verdict in Jefferson County

David Lee obtains a defense verdict in Jefferson County. During the week of January 25, 2010, David successfully defended Western World Insurance Company in an uninsured and an under-insured motorist claim.

This four-vehicle collision occurred on I-65 North near Valleydale Road as the under-insured motorist was attempting to merge onto the interstate from Valleydale Road. As she was attempting to merge into the right lane, the under-insured motorist swerved to avoid an uninsured motorist who had allegedly moved into the right lane to pass another vehicle. When the under-insured motorist swerved to avoid striking the uninsured motorist, she lost control of her vehicle and also allegedly lost consciousness which caused a four-vehicle collision on the interstate. The plaintiff was driving a dump truck and claimed that he suffered serious and permanent injuries as a result of the accident and was no longer able to drive commercial motor vehicles.

In a complicated set of facts and legal theories, David convinced the court that the uninsured driver was not guilty of negligence, as a matter of law, and also convinced the jury that the under-insured motorist was not guilty of negligence. The court entered a final judgment in favor of David's client, Western World Insurance Company.
