Jay Juliano Obtains Defense Verdict in Birth Trauma Claim

Jay Juliano won a defense verdict in the Circuit Court of Walker County in a jury trial involving a birth trauma claim.  The case involved the delivery of a baby following an approximate 20-minute period of bradycardia.  The claims against the defendant included failure to appreciate the significance of decelerations on fetal heart tracing and failure to notify the physician regarding same, as well as claims of failure to adequately resuscitate the infant immediately following delivery.  The baby suffered hypoxic ischemic encephalopathy resulting in significant neurological injuries including athetoid cerebral palsy.  Plaintiff’s counsel requested a verdict in the amount of $25,000,000 to $50,000,000.  The jury returned a unanimous verdict in favor of Parsons, Lee & Juliano’s client, a major hospital.
